Changing your name in England: the complete guide

To change your name in England you sign a deed poll in front of two independent witnesses aged 18 or over. That is the whole legal step. There is no government form to file, no court hearing and no waiting period. The moment the document is signed and witnessed, the new name is yours. UK Deed Poll prepares the document for £22.50, and the work that follows is telling the passport office, DVLA, HMRC, your bank and everyone else who still holds the old name.

This guide covers what a deed poll is, who can make one, the order to notify organisations in, and the two things a deed poll cannot do.

What a deed poll actually is

A deed poll is a signed declaration that you have given up your old name and will use a new one for all purposes. In England and Wales it is the standard proof of a name change, and it is what HM Passport Office, DVLA, HMRC, banks and employers expect to see.

The version almost everyone uses is called an unenrolled deed poll. Gov.uk puts it simply: you need two witnesses aged 18 or over, and you can use the signed document straight away as proof of your new name. Nothing is registered anywhere. The document itself is the proof, which is why the wording and the witnessing have to be right.

An adult deed poll from UK Deed Poll costs £22.50. Apply before 3pm Monday to Friday and it is prepared the same day and posted within two working days by First Class Post. If any organisation refuses to accept it, you get your money back (subject to our terms). We have issued more than 900,000 deed polls in 13 years.

Who can change their name in England

Anyone aged 16 or over can make their own deed poll. You do not need a reason and you do not need anyone’s permission.

For a child aged 15 or under, a parent or guardian applies on the child’s behalf, and everyone with parental responsibility has to agree. If they do not, the only route is a court order, which is a different process entirely. A child deed poll also costs £22.50.

There are a few rules on the name itself. It has to be pronounceable, it cannot contain numbers or symbols (a hyphen or an apostrophe in an established name is fine) and it must not be offensive. You also cannot use a deed poll to change only the capitalisation of your name, or to give yourself a title such as Sir or Doctor.

Choosing your two witnesses

This is the step people get wrong. Your witnesses must be 18 or over and, in practice, independent of you. Gov.uk warns that some organisations will not accept witnesses who share your address or are close relatives. Your husband, your mum or your flatmate is the wrong choice, even though nothing in law forbids it.

Pick two adults who are not family and do not live with you: a colleague, a neighbour, a friend. They sign after you, in your presence, and add their name, address and occupation. No solicitor is needed.

Who to tell, and in what order

Once the deed poll is signed, work through the organisations that hold your old name. The order below is deliberate. Your passport and driving licence are the photo ID every other organisation checks against, so do those early and the rest goes faster.

  • HM Passport Office. You get a new 10 year passport, and the time left on the old one is not carried over. Applying online costs £102, by paper form £115.50. One catch most guides miss: with a deed poll, the passport office also wants evidence that you are already using the new name, for example a payslip or a letter from your local council. If you do not have one yet, tell HMRC and your employer first and come back to the passport a few weeks later.
  • DVLA. Changing the name on your driving licence is free. Complete form D1 and send your photocard licence with your original deed poll. Photocopies are not accepted. If you own a vehicle, update the V5C log book at the same time.
  • HMRC. Gov.uk is direct about this one: you need to tell HMRC if you have changed your name. The online form or the HMRC app takes a few minutes.
  • Your bank and building society. Take the deed poll and your photo ID into a branch, or use the bank’s online process if it has one. Do every account, including credit cards and savings.
  • Your employer. HR needs the new name for payroll and your pension. Your next payslip is then your evidence for the passport.
  • Your GP and dentist. A call or a visit with the deed poll is enough to update your NHS record.
  • Your local council. Council Tax, the electoral register (you re-register to vote in your new name), and any parking permits or benefits.
  • Utilities and everything else. Energy, water, broadband, mobile, insurance, TV licence, subscriptions, HM Land Registry if you own property, Companies House if you are a company director.

That list is long, and each organisation has its own form or letter. The Name Change Kit costs £59.95 and gives you the completed forms and notification letters for HM Passport Office, DVLA, HMRC, the electoral register, Council Tax, HM Land Registry and Companies House, filled in with your details. You sign and post. An afternoon of hunting for forms becomes an hour at the kitchen table.

Enrolling a deed poll: optional, and most people skip it

An enrolled deed poll is one that has been put on public record at the Royal Courts of Justice. It costs £53.05, involves three court forms and a signature from a solicitor or authorised witness, and your name change and address are published in The Gazette.

It is not required. Gov.uk says only that some organisations, for example some banks, mobile phone companies or energy providers, may insist on the enrolled version. If that happens to you, enrolment can be done afterwards. It does not replace your deed poll, it registers it. And if any organisation refuses a UK Deed Poll document, our money back guarantee applies.

UK Deed Poll provides unenrolled deed polls only. We do not offer enrolment, and we are not a government agency.

What a deed poll cannot do

A deed poll does not change your birth certificate. The certificate records your name at birth and stays as it is. Your birth certificate and your deed poll together are the paper trail from the old name to the new one, so keep both safe.

It also cannot be backdated. Your new name starts on the day you sign.

Common questions

How long does it take to change your name in England?

The deed poll is valid the day you sign it. Apply before 3pm on a weekday and UK Deed Poll prepares it the same day and posts it within two working days. Updating your records takes longer, because each organisation works at its own pace. Plan around the passport, since it needs evidence that you are already using the new name.

Can I change my name without a deed poll?

If you are taking your spouse’s surname after marriage, your marriage certificate is usually enough. For any other change, including a new first name, a double barrelled surname or reverting after divorce to a name that is not on any certificate, organisations will ask for a deed poll.

Do I need a solicitor to change my name?

No. Gov.uk states that you can make a deed poll without a solicitor. Two adult witnesses are all the law requires. Where a solicitor does come in is enrolment at the court, which is a separate and optional step.

Will banks accept an unenrolled deed poll?

An unenrolled deed poll is the standard proof of a name change that a marriage certificate does not cover. Take the original into the branch with your current photo ID, and if you have already updated your passport or driving licence, bring that too. Gov.uk notes that a small number of organisations may ask for the enrolled version. If any organisation refuses your UK Deed Poll document, our money back guarantee applies.

Does a deed poll from England work in Scotland, Wales and Northern Ireland?

A deed poll is the route for England and Wales. Scotland records name changes through National Records of Scotland, and Northern Ireland has its own arrangements. If you live in either, check the local process before you order.

Sign your deed poll this week and the rest follows in order. Apply for an adult deed poll for £22.50, or choose the Name Change Kit and have every form ready to post the day your deed poll arrives.
