Yes, you can change your name before the divorce is final. A deed poll is a declaration you sign yourself in front of two witnesses. It is not a court order, it does not need your spouse’s agreement, and it does not wait for a conditional order or a final order. You can sign one the week you separate and start using your new name that day. What a deed poll will not do is end the marriage, change the financial settlement, or change your children’s names on its own.
If you are waiting for a letter from the court before you drop your married name, you are waiting for nothing. The final order (or the decree absolute, in older cases) ends the marriage. Your name is a different legal fact, and you can change it whenever you like.
GOV.UK puts it simply: if you are 16 or over, you can make a deed poll yourself and start using a new name. There is no line about being single, married, separated or divorced. There is no consent box for a husband or wife.
So you can go back to your maiden name in month one of a separation, or choose an entirely new surname, without asking anyone and without waiting for the court. The adult deed poll application takes a few minutes. Apply before 3pm Monday to Friday and it is prepared the same day and posted within two working days by First Class Post.
It helps to know which stage you are at, because you will be asked.
In England and Wales, for any divorce application issued on or after 6 April 2022, there are two court stages. You wait 20 weeks after the application is issued, then apply for a conditional order. You are still married at that point. At least 43 days after the conditional order (6 weeks and 1 day) you can apply for the final order, which ends the marriage.
If the court issued your application before 6 April 2022, the older terms still apply: decree nisi and decree absolute. Northern Ireland still uses decree nisi and decree absolute for all cases. Scotland has its own procedure and its own terms.
None of these stages touches your deed poll. You can sign it before you have even applied to the court.
Prepared the same day before 3pm. Accepted, or your money back.
The Passport Office does not ask for your divorce papers.
GOV.UK’s list for going back to a previous surname is:
No final order. No decree absolute. HM Passport Office’s own caseworker guidance goes further: it does not accept divorce documents on their own as evidence of a name change, because divorce documents issued in England and Wales since 1971 no longer show both names.
If you want a name that is not your maiden name (a previous married name, a new surname altogether, or a different first name), the Passport Office treats it as an ordinary change of name. Send a deed poll, plus one document showing you use the new name. The same guidance tells staff to accept an unenrolled deed poll as long as it is signed in the old and new name, signed by a witness, dated, and signed by hand in ink. That is exactly what a UK Deed Poll document is.
A new adult passport costs £102 online and is valid for 10 years. Time left on the old one is not carried over.
Once the deed poll is signed, the rest is admin. The order matters.
If you would rather not write those letters yourself, the Name Change Kit at £59.95 includes your deed poll plus completed forms and letters for HM Passport Office, DVLA, HMRC, the electoral register, Council Tax, HM Land Registry and Companies House. You sign, you post, it is done.
A deed poll is a name document and nothing more, so be clear on the limits.
It does not end the marriage. Only the final order does that. It does not touch the financial settlement, the court timetable, or any agreement about the house or pensions. It does not change your birth certificate, which stays as it was on the day you were born. And it does not change a child’s name on its own.
If any organisation refuses to accept a UK Deed Poll document, you get your money back, subject to our terms. In 13 years we have issued over 900,000 deed polls. UK Deed Poll is not a government agency. We prepare the document; you sign it with your witnesses.
This is the one place where the other parent does have a say.
To change a child’s name, everyone with parental responsibility has to agree. That usually means both parents. If one parent will not agree, GOV.UK says you must try to reach agreement first. If that fails, you can apply to the family court for a specific issue order on form C100. The court fee is £263, with help available for people on benefits or a low income.
HM Passport Office follows the same rule. For a child’s passport in a new name it needs the consent of everyone with parental responsibility, or a court order that gives authority to change the name.
When everyone agrees, the child deed poll is £22.50 and is prepared on the same 3pm timetable as an adult one.
No. An adult deed poll is your own declaration. Your spouse does not sign it, is not told about it, and cannot block it. The one exception is a child’s name, where everyone with parental responsibility must agree.
Yes. Sign a deed poll and start using your maiden name straight away. The Passport Office will want your marriage certificate to show the link between the two names, plus one document showing you use the maiden name. It does not ask when, or whether, the divorce finished.
No. The court case carries on regardless, and the settlement is about money and property, not names. Tell your solicitor so the paperwork stays consistent.
You can, but the final order on its own will not prove a name change to the Passport Office, and it only helps you go back to a name you already had. A deed poll works for any name, works today, and costs £22.50. If your divorce is already done, our guide to changing your name after divorce covers that route.
Two people aged 18 or over who are independent of you. Not your spouse, not your partner, not a relative, and not anyone who lives at your address. A friend, neighbour or colleague is fine.
